The Louisiana Department of Revenue (LDR) is responsible for fairly and efficiently collecting state tax revenues to fund public services, to regulate charitable gaming and the sale of alcoholic beverage and tobacco, and to support state agencies in the collection of overdue debts. Collectively, each program, unit, division and group work together to provide the core services to taxpayers of the State of Louisiana and stakeholders of the agency. LDR is comprised of the following groups: Tax Collection, Charitable Gaming, Alcohol and Tobacco Control (ATC), Debt Recovery and Louisiana Tax Free Shopping Commission.

The Tax Policy and Planning Division functions include development and issuance of Department policy statements, legislative drafting and monitoring, assistance with fiscal notes; rule promulgation, tax research and technical tax support. This is accomplished via the issuance of various policy statements, which include rules promulgated under the Administrative Procedure Act, private letter rulings, revenue rulings, revenue information bulletins, policy procedure and memoranda, and statements of acquiescence or non-acquiescence.

ABOUT THIS POSITION:

Duties include, but are not limited to:

  • Drafts tax regulations, Private Letter Rulings, Revenue Rulings, Policy and Procedure Memoranda, Revenue Information Bulletins and Statements of Acquiescence.

  • Participates in the formulation of tax policy by producing advisory opinions to the Secretary of the Department of Revenue.

  • Drafts or reviews the drafting of legislation sponsored by the Department.

  • Reviews proposed legislation to formulate advisory opinions as to overall effect of proposed legislation upon current law.

  • Attends legislative committee meetings and hearing and assists legislative staff as needed.

  • Drafts amendments and any other corresponding documentation needed with proposed legislation.

  • Issues advisory opinions on the effect of new legislation to department procedures and enforcement of tax laws.

  • Serves as legal advisor in matters dealing with Louisiana sales, severance, excise and miscellaneous tax and administrative matters under the provisions of the Louisiana Revised Statutes.

  • Provides background research on other applicable state governmental functions and statutes as they may impact the policies of the Department.

  • Performs administrative duties related to project status inventories and special projects including, but not limited to: project monitoring, issue tracking, time keeping and statistical case value tracking.

  • Reviews agency reports and records to ascertain whether there has been compliance with applicable laws, regulations, policies, or procedures, as needed

  • Performs other duties as assigned.

The Attorney 1 (AS-617) has a starting rate of: $27.08/hourly; $2,166.40 biweekly.

The Attorney 2 (AS-618) has a starting rate of: $28.98/hourly; $2,318.40 biweekly.

The Attorney 3 (AS-620) has a starting rate of: $32.02/hourly; $2,561.60 biweekly.

This position is in a Career Progression Group (CPG) and may be filled as an Attorney 1, 2 or 3 depending upon the qualifications of the candidate selected.

VACANCY INFORMATION:

ATTORNEY:

Litigates routine cases in trial and appellate courts and before administrative tribunals under the supervision of a higher ranking attorney.

Assists an attorney of higher rank in preparing major or complex cases for trial by drafting pleadings, interviewing witnesses, writing legal memoranda and briefs.

Enters claims for collecting monies due the state.

Assists in preparing proposed legislation.

Drafts tentative rules and regulations and reviews rules, regulations, and bulletins prepared by administrative officers for conformity to the law.

Investigates reports of violations of statutes and administrative rules and regulations.

Prepares advisory opinions for review by a higher ranking attorney.

Prepares or reviews legal documents, including contracts, licenses, deeds, and abstracts.

Researches laws applicable to the above activities.

ATTORNEY--ADMINISTRATIVE LAW JUDGES/REFEREES:

Convenes hearings that are of a routine nature; issues subpoenas; administers oaths; hears testimony; considers evidence; examines witnesses; maintains order; rules on motions, objections, admissibility of evidence and procedure; prepares and issues decisions and orders based upon all evidence gathered, research of pertinent statutes, pertinent jurisprudence, and independent assessment of acts based on credibility of witnesses and evidence.

Conducts pre-trial conferences with the attorneys to resolve preliminary issues and narrow the scope of the hearing to the facts actually in dispute.

Determines if there are jurisdictional or procedural issues to be disposed of and if so, decides the most appropriate manner (i.e. a limited hearing, an order to brief the issue, an order to amend the pleadings, a status conference, etc.) to address these issues.

Secures, compiles, and maintains all records of adjudications. Ensures that accurate records are maintained in the proceedings that evidence is properly marked and included in the case record, and that audio recordings are accurately marked and properly indexed and stores.

Conducts a continuous study of the current statues, regulations and case law related to areas of law for which hearings are assigned.
