Description of Job

Organizational Purpose

This work unit exists to enforce the Pesticide Act and the Pesticide Applicator’s Act. The statutes enforced deal with human health protection, consumer protection and environmental protection concerning the distribution and the application of pesticides.

Major Objectives of the Positions

This position exists to act as lead for the pesticide program's compliance assistance and enforcement activities and state-wide authority on the Private Pesticide Applicator Program. These activities are associated with pesticide enforcement activities in marijuana facilities, the commercial pesticide applicator program, private pesticide applicator program and the pesticide product registration program. This position acts as a subject matter expert for the pesticide programs compliance and enforcement activities and directs the field staff in the related activities such as investigations and inspections. Position compiles and analyzes evidence gathered during inspections or investigations of alleged misapplication of pesticides, determining the need for additional investigation and potential related violations. Position develops recommendations for appropriate actions, including Cease and Desist Orders, civil penalties and up to license revocation. Position prepares necessary documents or correspondence related to such action, conferring with legal counsel as necessary and testifying in administrative, civil and criminal proceedings. Interviews witnesses, reviews data, and gathers any pertinent evidence for reporting purposes. Position will travel overnight including up to one or more consecutive weeks at a time approximately 5-10% of the work year.

Work includes but is not limited to the following:

  • Review, summarize and compile evidence gathered during investigations of alleged misapplication of pesticides, or other section investigations.

  • Develop recommendations for appropriate action and prepare related documents or correspondence.

  • Testify in administrative, civil, and criminal proceedings.

  • Analyze enforcement actions and prepared relevant reports.

  • Track and monitor all investigations, enforcement actions, and compliance assistance activities.

  • Advise, guide, instruct, train field and enforcement staff as needed in investigation techniques, enforcement and compliance assistance, Investigation compilations, creation and issuance of enforcement actions and assuring that each activity performed meets existing quality management and safety.

  • Investigate, or lead investigations, of alleged misapplications of pesticides or other pesticide section related complaints by interviewing witnesses or other parties.

  • Act as the technical specialist for the pesticide enforcement cases and inspections resulting in violations regarding the interpretation, implementation, and enforcement of the United States Environmental Protection Agency (EPA) Worker Protection Standard (WPS) as it applies to private applicators including the marijuana industry. Leads activities of field and office staff regarding WPS by assigning and monitoring duties, giving directions, instructions and advice in routine inspections and investigations.

  • Tracks and monitors investigations, enforcement actions, and compliance assistance activities related to enforcement actions.

  • Using data from a variety of sources, analyze enforcement actions and related data and prepare relevant reports to be used to set priorities, objectives and goals, and establish policies and to present the results of enforcement activities to the Pesticide Advisory Committee, senior staff and the public upon request.

Salary Range:

$2,697.69 - $3,237.23 Biweekly

$70,140.00 - $84,168.00 Annually

Although the full salary range for this position is provided, appointments are typically made at or near the range minimum.

Minimum Requirements:

Proven Skills and Abilities:

  • Seven (7) years of professional experience in any regulatory capacity and/or professional pesticide use.

Education and Experience:

  • A combination of years of professional experience in any regulatory capacity and/or professional pesticide use and education from an accredited college or university with a bachelor's degree in a field of study related to plants or pest management (biology, botany, horticulture, agronomy, entomology, etc.), natural resources, paralegal studies or other closely related field of study

Preferred Qualifications:

  • Completion of a certificate program of paralegal studies.

  • Experience in any regulatory capacity, professional pesticide use, and/or paralegal work..

Conditions of Employment:

  • Must possess and maintain a valid Colorado Driver's License with the ability to independently travel.

  • Ability to travel overnight and weekday overnight including up to one week at a time approximately less than 5-10% of the work year.

  • Ability to lift up to 50 pounds.

  • Clear knowledge and experience with plant and pest management.

  • Knowledge of Colorado Pesticide Act. Knowledge of Worker Protection Standards.

  • Knowledge of investigatory procedures, reporting and documentation.

  • Ability to identify deficiencies in investigations.

  • Knowledge of pesticide regulatory processes.

  • Knowledge of chemistry/biology/agriculture.

  • Excellent interpersonal and communication skills.

  • Project management skills: ability to multitask, problem-solve, prioritize, create systems and processes, and collaborate with and engage others.

  • Ability to work in a fast-paced environment and juggle multiple priorities, and able to react and adjust quickly to changing conditions.

  • Detail oriented.

  • Excellent communication skills; able to communicate effectively and articulately in writing including technical writing.

  • Work well under pressure.

  • Strong relationship management skills and excellent representation of the department in interactions.

  • Ability work effectively and efficiently with diverse groups of people
