ATTORNEY LEGAL SERVICES HELENA, MT * * MISSION -Montana Department of Corrections is creating a safer Montana through Accountability, Rehabilitation and Empowerment. JOB OVERVIEW – This is an attorney position that gives the successful candidate the opportunity to be part of the important work and mission of the Montana Department of Corrections. The position is supervised by the Chief General Counsel in the Director’s Office. The successful candidate will have the opportunity to experience the wide array of policy and legal topics that impact the Department’s day-to-day work. This includes constitutional law, labor law, contracts, tort law, civil rights, and administrative law. Duties include: * Collaborate with Department staff and stakeholders to provide written and oral legal advice on the Department’s policy and programming directives. * Provide advice in all matters pertaining to public employment, including employee discipline, pre-termination due process, state classification and compensation, employee grievances, FMLA and ADA, and matters concerning collective bargaining units. * Assist in the Department’s contracting processes, including drafting, reviewing, and negotiating contracts, requests for proposals, memoranda of understanding, and labor union agreements. * Develop, draft, and promulgate Department policies, procedures, and administrative rules. * Review and assist with public records requests. * Support the Department in the legislative process, including drafting and reviewing legislation and fiscal notes. * Provide training and ongoing guidance for both new and existing staff. * As needed, support and represent the Department in ongoing legal proceedings, including court proceedings, administrative hearings, investigations, arbitration, and mediation. * The majority of the work is located in Helena, but the position may be in a different location if suitable office space and arrangements can be made.
