In the 2023 legislative session, the Governor’s Office, Minnesota legislature, and leaders for children and families worked in partnership to pass legislation establishing the Department of Children, Youth, and Families (DCYF) to create a sustainable, public face for children’s issues in state government. This new cabinet-level agency brings together programs centered on children and families, including child care and early learning, child support, child safety and permanency, economic support and food assistance, and youth opportunity. The Department of Children, Youth, and Families (DCYF) officially formed on July 1, 2024.

As Assistant Deputy General Counsel, you will provide legal expertise to the Department of Children, Youth, and Families (DCYF), with a focus on employment law, labor law, and affirmative action/equal opportunity. The individual in this position will be responsible for providing the Department with legal advice in a variety of complex and changing areas affecting the Department to support the Department’s compliance with all state and federal laws, assisting the Deputy General Counsel with coordinating the Department’s litigation, and collaborating with other Department staff concerning implementation of Department legal policies and best practices. The individual in this position will conduct complex legal and policy research producing written products tailored to a variety of audiences and purposes. The individual in this position will have a high level of freedom to act with the authority to speak on matters related to their position. This position will also be providing legal advice on employment and labor law matters including employment investigations, discipline, arbitrations, grievances, dispute resolution process in the plans, and collective bargaining process matters.

Responsibilities include but may not be limited to:

  • Using research and writing skills, support the litigation and policy work of the Department by conducting legal and policy research to produce written products that collect and apply research to issues concerning the Department.

  • Using knowledge of case law, statutes, and of how courts apply law to facts, provide legal advice to managers, executives, and staff on various topics within the Department, including employment and labor law matters.

  • Monitor litigation involving the Department to coordinate litigation-related information and activities in support of favorable outcomes for the Department.

  • Complete special projects as assigned by the Deputy General Counsel.

Minimum Qualifications

To facilitate proper crediting, please ensure that your resume clearly describes your experience in the areas listed and indicates the beginning and ending month, day and year for each job held.

  • Juris Doctorate (JD) degree from an ABA accredited law school.

  • Current license and in good standing to practice law in Minnesota.

  • At least five (5) years’ experience as a practicing attorney in the area of employment law, labor law, and/or affirmative action/equal opportunity.

  • Experience must demonstrate the following:

  • Strong legal research, analysis, and writing skills.

  • Building and maintaining good working relationships with internal and external stakeholders.

  • Providing legal advice to executive leadership on diverse and complex human services and data privacy matters.

  • Experience in multiple areas of law.

Preferred Qualifications

  • Experience working with a CEO and an executive board.

  • Experience representing clients in civil litigation.

  • Experience working with the Attorney General’s Office and/or State government agencies.

  • Experience advising senior leadership.

  • Knowledge of and experience handling issues related to state and federal privacy laws relating to Health Insurance Portability and Accountability Act and the Minnesota Government Data Practices Act.

  • Experience with representing employers with a unionized workforce.

  • Variety of experiences working effectively with others from different backgrounds and cultures.
