The Minnesota Department of Human Services, Office of Inspector General (OIG) – Legal Division is hiring four attorneys to be agency-wide experts in each of the following bodies of law:

· Child care centers – all state and federal laws and caselaw impacting regulation and enforcement for child care center licensing and certification.

· Family child care – all state and federal laws and caselaw impacting regulation and enforcement for family child care licensing.

· Child foster care – all state and federal laws and caselaw impacting regulation and enforcement for child foster care licensing.

· Child care assistance program (CCAP) – all state and federal laws and caselaw impacting regulation and enforcement for CCAP program integrity oversight.

Each of these areas is rapidly evolving in our State, and each of these areas is also preparing to transition to the Minnesota Department of Children, Youth, and Families (DCYF) in July 2025, consistent with 2023 Minnesota Session Law, Chapter 70, and 2024 Minnesota Session Law, Chapter 80. We need brilliant, thoughtful counsel who are able to apply a deep level of substantive legal knowledge to the primary task of providing strategic legal advice and litigation oversight in each of the above areas. Each position will be the agency-wide substantive expert in their area of specialty and will advise OIG leadership and legal consultation as needed to OIG and agency leadership when other OIG or agency areas are navigating a space that intersects with the above four areas of expertise. Each position will also be at the forefront of advising on complex, high profile legal matters.

These positions will join the newly formed OIG Legal – Children, Youth, and Families (CYF) team, and report directly to the OIG Legal – CYF deputy chief legal counsel.

Responsibilities include but are not limited to the following:

· Provide written and oral legal research and advice to OIG leadership on emerging issues.

· Provide consultation with agency leadership and program areas, whose work intersects with your primary business area.

· Develop legal strategies for approaching litigation and compliance questions unique to your primary business area that will serve as a guide for other attorneys who support litigation in your primary business area.

· Develop relationships with key partners within the agency and across agencies to ensure that legal strategies are comprehensive and take into account the many factors impacting providers that operate within your primary business area.

· Advise, negotiate, and draft contracts and interagency as needed for your primary business area.

· Serve as the Minnesota Government Data Practices legal point of contact for your primary business area.

· Provide legal analysis, legal advice, and practical assistance to assigned business units within the Department with regard to all aspects of rulemaking.

Minimum Qualifications

· JD degree from an ABA accredited law school;

· Current license and in good standing to practice law in Minnesota;

· At least five (5) years’ experience as a practicing attorney in an area of law directly related to these positions.

Experience must demonstrate the following:

· Strong legal research, analysis, and writing skills;

· Ability to develop legal advice and litigation strategies independently;

· Ability to build and maintain good working relationships with internal and external stakeholders;

· Providing legal advice to executive leadership on diverse and complex human services and data privacy matters;

· Litigation experience; and

· Ability to provide legal advice that crosses over multiple areas of law, specifically, any of the specialties list above and their intersection with civil law or other administrative law specialties such as data practices and administrative law procedure.

Preferred Qualifications

· Expertise in contract law, Adam Walsh Act, Child Care & Development Block Grant, Limit on Receiving Public Funds at Minnesota Statutes, section 245.095, and government data practices law.

· Ability to communicate complex legal concepts to persons with non-legal backgrounds.

· Demonstrated ability to integrate complex non-legal factors to develop legal advice and strategies in high profile matters.

· Demonstrated strong emotional intelligence, strategic leadership, change management, and diversity equity and inclusion skills are essential components for effective job performance.

· Demonstrated ability to communicate effectively with a large and varied constituency, including legislators and legislative staff, the Attorney General’s Office, state local and federal agencies, professional and advocacy groups, as well as the general public.

· Demonstrated ability to maintain composure and convey competency, equanimity, and collaboration in stressful situations.

· Identify common ground for parties with varied interests and build consensus toward solutions.

· Analytical skills to assimilate information and apply it in strategic, decision-making processes.

· Facilitate conflict resolution and ensure competing interests are appropriately balanced.

· Variety of experiences working effectively with others from different backgrounds and cultures.
